HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7137 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/ accused Nos.1 to 3 under Section 482 Cr.P.C seeking to quash the Crime No.218 of 2015 of Gajuwaka Police Station, Visakhapatnam, Visakhapatnam District, registered for the offences punishable under Sections 417, 420 r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act.

2) Heard learned counsel for the petitioners/ accused Nos.1 to 3 and 1st respondent-State represented by learned Public Prosecutor before admission and before ordering notice to 2nd respondent-de facto complainant. Perused the material on record.

3) The facts falls short for this Court to admit the Criminal Petition filed under Section 482 Cr.P.C to quash the FIR and investigation shall go on, the petitioners are at liberty to file additional material in their favour before the Investigation Officer to consider as part of investigation. Pending investigation, the learned Magistrate shall dispense with the presence of the petitioners before the Court, so as to summon them in the event of police final report and taken cognizance taken there from. Further remedies are left open in the event of police filing final report.

4) Accordingly, the Criminal Petition is disposed of.
