HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY CRIMINAL PETITION No.5574 of 2024 ORDER:

This petition is filed under Sections 437 and 439 of the Criminal Procedure Code seeking to enlarge the petitioner, who is accused No.2, on bail in Crime No.3 of 2024 registered with Prohibition & Excise Police Station, Secunderabad for the offences under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'NDPS Act'). 2.

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the respondent-State. 3.

Learned counsel for the petitioner submitted that bail was granted by this Court by order dated 09.05.2024 in Criminal Petition No.5209 of 2024 in respect of accused No.3. The petitioner is also similarly placed as accused No.3.

The said contention is not disputed by learned Assistant Public Prosecutor.

In view of the above, the Criminal Petition is allowed and the petitioner/accused No.2 shall be enlarged on bail subject to the following conditions:

(i) The petitioner/accused No.2 shall execute a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties one from local place and the other from native place for a like sum each to the satisfaction of the XXII Additional Chief Metropolitan Magistrate, Secunderabad.

(ii) The petitioner/accused No.2 shall appear before the concerned SHO at 11.00 A.M. on every Monday, for a period of eight (8) weeks for the purpose of investigation and thereafter, as and when required.

(iii) The petitioner/accused No.2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (iv) If any adverse report is received against her, the bail granted is liable to be cancelled.

Pending Miscellaneous Applications, if any, in this Criminal Petition, shall stand closed.
