HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No.175 of 2016 ORDER:
When the matter is coming up for hearing, the learned counsel appearing for respondent submitted that O.S.No. 112 of 2014 itself was disposed of on 2.12.2015 by producing a copy of the judgment in the said suit.
Thereupon, the learned counsel for petitioner made an endorsement that liberty may be given to him to raise the issues involved in the Civil Revision Petition in the appeal against the judgment in O.S.No. 112 of 2014.
Since the Civil Revision Petition became infructuous in view of the fact that the main suit O.S.No. 112 of 2014 is disposed of, the Civil Revision Petition is dismissed as infructuous. However, liberty is given to the petitioner in the Civil Revision Petition to raise all the pleas that are legally permissible to him in the appeal. With this observation, this Civil Revision Petition is dismissed as infructuous. There shall be no order as to costs.
