HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY CRIMINAL PETITION No.5584 of 2024 ORDER:

This petition is filed under Sections 437 and 439 of the Criminal Procedure Code seeking to enlarge the petitioner, who is accused No.1, on bail in Crime No.105 of 2024 registered with Bachupally Police Station for the offences under Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'NDPS Act').

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the respondent-State. 3.

Learned counsel for the petitioner submitted that in similar circumstances, accused No.2 was granted bail by this Court by order dated 16.05.2024 in Criminal Petition No.5482 of 2024. The petitioner is also similarly placed as accused No.2.

A copy of the order dated 16.05.2024 passed in Criminal Petition No.5482 of 2024 is placed on record. 5.

The said contention is not disputed by learned Assistant Public Prosecutor.

In view of the above, the Criminal Petition is allowed and the petitioner/accused No.1 shall be enlarged on bail subject to the following conditions:

(i) The petitioner/accused No.1 shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties including one local surety, for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge, Medchal-Malkajgiri District at Kushaiguda.

(ii) The petitioner/accused No.1 shall appear before the concerned S.H.O at 11.00 A.M. on every Monday, for a period of eight (8) weeks for the purpose of investigation and thereafter, as and when his presence is required.

(iii) After release, if the petitioner is involved in similar offence again, the bail granted by this Court shall stand cancelled.

(iv) The petitioner/accused No.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. Pending Miscellaneous Applications, if any, in this Criminal Petition, shall stand closed.
