THE HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY CRIMINAL PETITION Nos. 5576 and 5577 of 2024 COMMON ORDER:

These two petitions are filed under Sections 437 and 439 of the Criminal Procedure Code seeking to release the petitioners on bail in Crime No.175 of 2024 of Suryapet (Rural) Police Station, Suryapet, registered for the offences under Sections 143, 147, 153A, 307, 452, 427 and 506 read with 149 I.P.C. 2.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

The petitioners herein are accused Nos.1 to 8 and 10 to 28. It is alleged that the petitioners and other accused are found in unlawful assembly, armed with deadly weapons, rioting, promoting enmity between different groups i.e., two political parties, attempt to murder, criminal trespass, commit mischief and thereby caused loss or damage worth Rs.50,000/-. It is alleged that on 03.05.2024 at about 18:40 hours at Yarkaram Village, accused Nos.1 to 29 have formed into an unlawful assembly armed with deadly

BVR,J crlp_5576&5577_2024 weapons, trespassed into the house of de facto complainant, one Pittala Saidulu and Gundlapally Naveen, all are residents of Yarkaram Village, damaged complainant's Pulsar Motorcycle bearing No.TS-29-G-5713 and household articles i.e., fridges, TVs and cots with stone and caused loss of property. The accused persons with a political grudge had planned to murder the de facto complainant. The petitioners were arrested on 04.05.2024 and remanded to judicial custody.

Learned counsel for the petitioners submitted that major part of investigation is completed. There are no allegations in the First Information Report so as to attract the offence under Section 307 IPC. There are no injuries inflicted on the de facto complainant. It is a made up case only for political reasons. 5.

As seen from the remand case diary, eight witnesses have been examined. L.W.1 is the complainant. L.Ws. 2 to 4 are eyewitnesses to the alleged incident. L.Ws.5 to 6 are panch witnesses for scene of offence panchanama and L.Ws.7 and 8 are panch witnesses for confession-cum-seizure panchanama.

Taking into consideration the fact that there are no allegations against the petitioners in causing any injuries to the de facto complainant and others and that major part of investigation is being completed, this Court is inclined to grant bail to the petitioners.

In view of the above, these two Criminal Petitions are allowed and petitioners - accused Nos.1 to 8 and 10 to 28 are directed to be enlarged on bail on their executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to the satisfaction of learned Additional Judicial Magistrate of First Class, Suryapet. The petitioners shall abide by the conditions stipulated in Section 437

(3) of Cr.P.C.

Miscellaneous petitions, if any, pending in these petitions shall stand closed.
