Heard Sri T.Balaji for petitioner and the Assistant Government Pleader (Assignment) for respondents. The petitioner prays for the following relief :- " .... to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the order of the 2nd respondent passed in D.Dis.E3/ 18665/ 98, dated 28.08.2009 confirming the order of the 3rd respondent dated 04.10.1996 made in his proceedings Roc.D/ 4365/ 96 cancelling the DKT No.248/ 4/ 1404 dated 6.6.1995 of the 4th respondent in respect of the land to an extent of Ac.5-00 in Sy.No.647 situated at Allamadugu Village, Vedurukuppam Mandal, Chittoor District and set aside the same...."
It is matter of record that the petitioner aggrieved by the order of 2nd respondent, dated 28.08.2009, preferred revision before the 1st respondent. The 1st respondent through communication CCLA's.Ref.No.BCW2/ 452/ 2009 dated 08.12.2009 called for record and remarks from respondents 2 to 4. After perusing the material on record, this Court is of the view that the merits of the grievance at this stage need not be considered by this Court and to meet the ends of justice, the writ petition can be disposed of by this order.
(a) Interim order granted on 26.02.2010 is directed to be continued during pendency of
revision in CCLA's.Ref.No.BCW2/ 452/ 2009 before the 1st respondent.
(b) The 1st respondent considers and disposes of revision as expeditiously as possible preferably within four months from the date of receipt of a copy of this order.
(c ) The petitioner is given liberty to raise additional grounds or file additional material relied upon in this writ petition, if so advised. The writ petition is disposed of accordingly. No order as to costs.
