HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.46011 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioner seeking to declare the action of the respondents in not including the name of the petitioner in the list of 'Encroachers to whom ex-gratia is payable for the lands being taken over for Medtech Park under Encroachments in Sy.Nos.480/2 and 176 of Nadupruu Village of Pedagantyada Mandal, Visakhapatnam District', in terms of G.O.Ms.No.571 dated 14.09.2012, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned AGP for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself. Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent for disposal of the representation dated 21.12.2016 made by the petitioner seeking to defer the payment of compensation and to conduct an enquiry for inclusion of his name in the list of beneficiaries and consequently to pay him the exgratia/compensation.

Learned AGP would submit that the 2nd respondent may be directed to consider the representation of the petitioner, if the same is still pending consideration.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-District Collector to consider the representation dated 21.12.2016 made by

the petitioner seeking to defer the payment of compensation, to conduct an enquiry for inclusion of his name in the list of 'Encroachers to whom ex-gratia is payable for the lands being taken over for Medtech Park under Encroachments in Sy.Nos.480/2 and 176 of Nadupruu Village of Pedagantyada Mandal, Visakhapatnam District', consequently to pay him the exgratia/compensation in terms of G.O.Ms.No.571 dated 14.09.2014 and pass necessary orders thereon, in accordance with law, after hearing the petitioner and other aggrieved persons, if any, as early as possible, if possible within a period of one week from today.
