HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRL.P.No.4290 OF 2018 ORDER:
This criminal petition is filed under Section 439(1)(b) Cr.P.C to relax the conditions imposed in Crl.M.P.No.120 of 2018 in Crime No.967 of 2017 by the Special Sessions Judge for trial of Cases under SCs & STs (POA) Act-cum-VII Additional District and Sessions Judge, Ranga Reddy District at L.B.Nagar on the ground that he is not in a position to furnish sureties and that his mother is working as servant maid on meagre monthly salary. The Special Sessions Judge by order dated 15.03,2018 in Crl.M.P.No.120 of 2018 enlarged the petitioner on bail on his executing bond for Rs.20,000/- with two sureties for a like sum each to the satisfaction of VII Metropolitan Magistrate, Cyberabad at Hayathnagar and the petitioner shall attend before SHO, P.S. Vanasthalipuram on every Sunday between 08.00 AM to 02.00 PM till filing of charge sheet.
But the petitioner is in jail as he is unable to furnish sureties to the satisfaction of the Court. Though the petitioner appears to be poor man, he is not required to deposit any cash before the Court, but furnishing sureties having immoveable property worth more than Rs.20,000/- is sufficient. Therefore, the Court concerned is directed not to insist for cash sureties, if the petitioner furnishes immoveable property as sureties worth more than Rs.20,000/- subject to compliance of other requirements. With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions in the petition, if any, shall stand closed.
