The case of the petitioner is that she was sanctioned Family Pension vide proceedings dated 18.10.2012, but, basing on a false complaint, impugned proceedings dated 25.05.2017 were issued for stoppage of payment of family pension besides recovery of Rs.1,43,499/-, without any notice, opportunity and enquiry.
This Court on 06.04.2018 granted interim stay of recovery.
Learned Government Pleader for Services seeks time. A perusal of the impugned proceedings goes to show that no notice was issued to the petitioner before stopping the pension and recovery, which is in violation of principles of natural justice. In view of the same, only on the ground of violation of principles of natural justice, the impugned proceedings are set aside. However, it is open for the competent authority to take appropriate action, in accordance with law. Accordingly, the writ petition is allowed. No order as to costs.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 13.04.2018 tk
