HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 12593 of 2015 ORAL ORDER:

Heard learned counsel for petitioner, learned Government Pleader for Municipal Administration and Urban Development and Sri P Keshav Rao, learned standing counsel for respondent GHMC and with their consent, the writ petition is taken up for disposal at the admission stage.

2. This writ petition is filed questioning the action of respondents 1 to 4 in not taking action on the representation of the petitioner dated 13.4.2015 with regard to illegal constructions made by respondents 5 to 8 on Plot No. 627/A part of Survey No. 128/1 and 128/5 bearing H No. 8-3-228/678/1528 and 8-3-228/678/1703, Sriram Nagar, Yousufguda, Hyderabad as illegal.

3. Petitioner claims that she is owner of the subject property. However, admittedly, land grabbing case in L.G.O.P. No. 409 of 2013 on the file of the XIV Additional chief Judge, City Civil Court, Hyderabad is pending on remand from the Land Grabbing Tribunal. Earlier raising similar grounds petitioner filed W.P. No. 1040 of 2010 which was disposed of by this Court by order dated 29.12.2011 directing the official respondents therein to consider representation of the petitioner.

Petitioner alleges that once again respondents 5 to 8 started making illegal constructions and though, petitioner vide his representation dated 13.4.2015 brought the same to the notice of official respondents, no action is taken. Hence, the present writ petition.

4. When the matter is taken up, counsel for petitioner submitted that it would suffice to dispose of the writ petition with a direction to second respondent to dispose of representation of the petitioner dated 13.4.2015 expeditiously.

5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing second respondent to consider the representation of the petitioner dated 13.4.2015 and after affording reasonable opportunity to respondents 5 to 8, pass appropriate orders as warranted under law within a period of six weeks from the date of receipt of copy of this order and communicate the decision to the parties. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
