Heard.
The grievance of the petitioner is that his application, dated 12-12-2014 seeking permission to dig a bore well is not being considered by the 3rd respondent in spite of paying requisite fee. The petitioner states that the 3rd respondent has called for a report from the Deputy Director, Ground Water Officer, Karimnagar, on 1402-2015, but thereafter he has not taken any further steps and not considered his application. The petitioner also states that he is the owner of the lands admeasuring Ac.2-06 gts., in Sy.No.230, Ac.0-16 gts., in Sy.No.323/C and Ac.0-08 gts., in Sy.No.320/B situated at Sundaragiri Village, Chigurumamidi Mandal, Krishna District and the bore well sought to be dug by him is clearly permissible under the WALTA Act.
Learned Government Pleader has received instructions from the 3rd respondent, which refers to the report of the Village Revenue Officer, Sundaragiri, relating to the existing bore well. However, the 3rd respondent cannot keep the petitioner's application pending and he is required to consider the same in terms of the WALTA Act and pass appropriate orders either accepting or rejecting the petitioner's request, so that the petitioner can atleast avail further remedies available to him.
In the circumstances, the 3rd respondent is directed to consider the petitioner's application in accordance with law, as directed above, and pass appropriate orders, expeditiously, preferably within two weeks from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
