HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6431 OF 2017 ORDER:

This writ petition is filed challenging the proceedings No.B/3048/2014, dated 02.09.2014 issued by the 5th respondent, wherein the Mandal Revenue Inspector was directed to take over the physical possession of the land to an extent of Ac.8.00 guntas in Survey No.73 of Mallapur Village, into government custody by removing all encroachments in the aforesaid land and also to take necessary measures for protection of the said government land by erecting sign board in the land and to report compliance.

Learned counsel for the petitioners submits that at the time of dismissal of WP.No.2797 of 2016 dated 10.11.2016, filed by the petitioners against the orders of the Land Grabbing Tribunal in OP.No.796 of 1990, dated 26.08.1994, this Court orally observed that the said lands have to be assigned to the petitioners.

It is to be seen that the OP.No.796 of 1990 filed by the revenue authorities was allowed on 26.08.1994 in favour of the Government and challenging the same the petitioners filed WP.No.2797 of 2016 and the same was dismissed on 10.11.2016. A perusal of the order in WP.No.2797 of 2016 goes to show that there is no such observation as contended by the learned counsel for the petitioners. When once the

land grabbing proceedings have become final and custody of the subject land was taken by the Government, petitioners cannot plead ignorance about the land grabbing proceedings and start the litigation, once again. In view of the same, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. No order as to costs. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 06.03.2017 tk
