HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.15533 OF 2011 ORDER:

The petitioner complains against the inaction of respondent No.1 in stopping illegal construction in Plot No.3, Survey Nos. 29 part, 30 to 32 admeasuring 250.59 square yards at Rasoolpura, Secundrabad Cantonment, as illegal and arbitrary. The learned standing counsel, on instructions, submits that as on today, the construction activity against which a complaint is made is not being undertaken and the 1st respondent has deputed officers to inspect the site and places on record the latest photographs in support of his submission that the construction work is not undertaken by 2nd respondent.

By placing on record the submission of learned standing counsel, the writ petition is dismissed. If further cause arises with the changed circumstances or again 2nd respondent undertakes any construction at subject site, liberty is given to petitioner to pursue the legal remedies.
