HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Second Appeal No. 1131 of 1999 Judgment:

Learned counsel for the appellants represents that the appellants 1 and 2 are no more and even the sole respondent is no more. Learned counsel for the sole respondent also represents that the death of the respondent had occurred on 08th May 2006 and, therefore, the appeal abates.

2. Despite the fact that the sole respondent is no more and his death occurred about more than eight years back, no steps have been pursued. Hence, the instant second appeal stands abated. There shall be no order as to costs.

3. As a sequel thereto, miscellaneous applications, if any, pending in the second appeal, shall stand closed.
