THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.40157 OF 2016 ORDER:

Alleging that the property occupied by the petitioner is seized by the respondents on the ground that the property tax arrears were not paid, this Writ Petition is filed.

Learned counsel for the petitioner vehemently contended that no prior notice or opportunity was given to the petitioner before seizing the property and therefore the same is illegal.

Learned Standing Counsel for Greater Hyderabad Municipal Corporation, on instructions of Sri Narayana Rao, Assistant Municipal Commissioner, who is present in the Court, submits that the Municipal Corporation has not seized the property in question.

The allegation made in the Writ Petition that the property of the petitioner was seized, is without any basis. When it is categorical assertion of the respondent - Municipal Corporation that they have not seized the property, the prayer sought for in the Writ Petition cannot be granted and the Writ Petition is liable to be dismissed.

The Writ Petition is accordingly dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
