HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.775 of 2014 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.1 and 2 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.319 of 2013 of III Town Police Station, Nizamabad registered for the offences punishable under Sections 423, 406 and 506 I.P.C.

2) When the matter came up for hearing, the respondent State represented by the Public Prosecutor submitted that in the above crime, the police concerned filed final report stating that the case is of civil in nature and referred the matter under Section 173 Cr.P.C.

3) Having regard to the same, the petition is disposed of giving liberty to the petitioners, in the event of taking of cognizance under Section 190 Cr.P.C from that material or after any protest petition under Section 200 read with 190 Cr.P.C by the learned Magistrate concerned, remedy is left open to the petitioners afresh before appropriate forum.
