The petitioner challenged the proceedings in Rc.B/66/2016, dated 19-01-2017 of the Tahsildar, wherein her application for mutation is rejected stating that after subdivision of subject land, mutation and E-Passbook will be granted.

Learned counsel for the petitioner submits that the petitioner has already made application for sub-division of patta by paying necessary fee. Without first considering the said application, the respondent-authorities have refused the application for mutation. He also relied on the judgment of A.Krishna Reddy v. Tahsildar, Shamshabad Mandal, Ranga Reddy1.

Heard learned Assistant Government Pleader for Revenue.

When the petitioner has filed application for subdivision of patta, the 3rd respondent should have taken that application at first and after considering the same, the 3rd respondent should have considered the application filed in Form VI-A for mutation of her name.

In view of the same, impugned order is set aside. The 3rd respondent is directed to take-up the application of the petitioner for sub-division of patta at first and thereafter 1 2008(3) ALT 46

consider the application of the petitioner for mutation. The said exercise shall be done within a period of three months from the date of receipt of a copy of this order. With the above direction, this writ petition is disposed of.
