HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No. 713 OF 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This appeal is directed against the order, dated 29.06.2015, passed in W.P.No.16563 of 2015 by which writ petition was disposed of in view of the concession made by learned counsel for the appellants/petitioners.
Learned counsel for the appellants across the bar states that he never gave consent for the order that has been passed by learned Single Judge. When we asked him whether he has made such statement on affidavit in support of miscellaneous petition or in the memorandum of appeal, his answer was in negative.
From the tenor of the order it is clear that the appellants have given consent for the order and they cannot now turn around and say that such consent was not given. Even on merits we do not find any substance, since the impugned order does not cause any prejudice to the petitioners. In the circumstances, we find no merit in the writ appeal. Writ appeal is accordingly dismissed.
Miscellaneous petitions, if any, shall also stand dismissed. _________________________
