Heard the counsel for petitioner, and Sri P. Sree Ramulu Naidu, counsel for respondent.

This Writ Petition was filed by petitioner seeking consideration of his candidature for the post of Assistant Registrar in the respondent-University.

3. Interim order was granted on 25.08.2008 by this Court directing the respondent to consider the case of petitioner for promotion to the post of Assistant Registrar as and when made by treating his date of appointment as 30.05.1995.

It is now stated that, pursuant to this order, petitioner was considered for appointment to the post of Assistant Registrar and he was promoted to the said post as well as to the next higher post of Deputy Registrar and he retired from service on 30.06.2013.

The counsel for petitioner states that the retirement benefits of petitioner have not been released by respondent on the pretext that the Writ Petition is pending. 6.

Having extracted work from petitioner, both as Assistant Registrar and Deputy Registrar and having allowed him to retire on the above date, it is most

unfortunate that the respondent-University has withheld the retirement benefits on the pretext that the Writ Petition is pending.

7. Therefore, the Writ Petition is disposed of directing 2nd respondent to release the retirement benefits of petitioner forthwith, since the cause in the Writ Petition no longer survives for adjudication in view of the retirement of petitioner. No order as to costs.
