THE HONOURABLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.1120 of 2006 ORDER:

The criminal revision case is filed in the year 2006. On 27.08.2019, this Court passed the following order: "This criminal revision case is filed in the year 2006. The docket proceedings would indicate that the notice is not sent to the first respondent till date. The matter was referred to Mediation and Arbitration Centre for mediation. Though notices were issued to both parties and the learned counsel, the parties remained absent and did not attend for mediation. Therefore, the matter has been returned to place before the Court.

Therefore, issue notice to the first respondent. Learned counsel for the petitioner is also permitted to take out personal notice to the first respondent through RPAD and file proof of service in the registry.

Post on 11.09.2019."

On 02.12.2019, there was no representation on behalf of the petitioner as well as no proof of service is filed in compliance with the order, dated 27.08.2019. Even today also, there is no representation on behalf of the petitioner, in spite of the matter listed under the caption 'for dismissal'. From this, it appears that the petitioner is not interested to prosecute the matter diligently. Even on merits also, the petitioner has absolutely no case, since the maintenance as awarded by the Court below is very meager when compared to the salary of the petitioner and the standard of living by virtue of inflation.

Accordingly, on both the counts, the Criminal Revision Case is dismissed for non-prosecution.

As a sequel, miscellaneous petitions pending, if any, shall stand dismissed.
