With the consent of both the parties, the Writ Petition is disposed of at the admission stage.
This Writ Petition is filed seeking the following relief: ".........to issue Writ of Mandamus by declaring the action of the respondents in not considering the case of the petitioner for promotion to the post of Hostel Welfare Officer Grade-I, as per her seniority though the petitioner submitted her objections on 15.05.2019 to the 3rd respondent, but, without passing any final orders, now the respondents are effecting promotions to the post of Hostel Welfare Officer Grade-I at Khammam District is highly illegal, arbitrary, unreasonable, discriminatory and also in violation of Articles 14, 16 and 21 of the Constitution of India and declare the same as bad in law and consequently direct the respondents to consider the case of the petitioner for promotion to the post of Hostel Welfare Officer Grade-I as per her seniority by passing final orders on her objections made to the 3rd respondent on 15.05.2019 and ......." Heard Sri C.Raja Sekhar Reddy, learned counsel for the petitioner, and the learned Government Pleader for Services-II.
It has been contended by the petitioner's counsel that the petitioner is working as Hostel Welfare Officer Grade-II and she is fully eligible and qualified to be promoted to the post of Hostel Welfare Officer Grade-I. But, the respondents are not considering her case for promotion. The respondents
WP.13725/2019 AKS,J have prepared a list of 25 candidates, who could be promoted to the post of Hostel Welfare Officer Grade-I. In the said list, the name of the petitioner is placed at Sl.No.25 instead of Sl.No.23. In those set of circumstances, the petitioner has submitted representation/objections on 15.05.2019 requesting the respondents to place her at Sl.No.23 instead of Sl.No.25 in the said list. But so far, the respondents have not passed any orders on the said representation nor considered the case of the petitioner for promotion to the post of Hostel Welfare Officer Grade-I. Therefore, the Counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representation, dated 15.05.2019, and pass appropriate orders and also to direct the respondents to consider the case of the petitioner for promotion to the post of Hostel Welfare Officer Grade-I.
Learned Government Pleader appearing for the respondents submits that the representation submitted by the petitioner on 15.05.2019 would be considered by the respondents and appropriate orders will be passed thereon. Having regard to the rival submissions made by the parties, this Court is of the considered view that the Writ Petition can be disposed of directing the respondents to consider the representation, dated 15.05.2019, submitted by the petitioner and pass appropriate orders in accordance with
WP.13725/2019 AKS,J law within a period of eight (8) weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs. As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
