THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 6241 of 2015 Order:
This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, by the petitioner/A2, seeking to quash the proceedings pending against her in C.C. No. 28 of 2014 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad, for the offences punishable under Sections 498(A) and 406 IPC and Sections 4 and 6 of the Dowry Prohibition Act.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State.
3. A perusal of the record would show that there is material, prima facie, sufficient to enquire into the allegations made against the petitioner/A2 in the charge sheet. There are no valid grounds to quash the proceedings against the petitioner/A2.
4. At this stage, learned counsel for the petitioner/A2 submits that the petitioner/A2 is aged about 75 years and it will be difficult for her to attend for each and every adjournment in the above case and prays that the presence of the petitioner/A2 may be dispensed with.
5. The Criminal Petition is, accordingly, dismissed. However, the learned XIII Additional Chief Metropolitan Magistrate, Hyderabad, is directed to proceed with the case in C.C. No. 28 of 2014 without insisting for the presence of the petitioner/A2 herein for each and every adjournment, unless her presence is necessary for any specific purpose.
6. As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed. __________________
