HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Aggrieved by the proceedings No.D3/13125/81, dated 11.12.1994 securing allotment of land by respondent no.4 and others, Ishwardas s/o late Narsinghdas filed Review Petition No.E3/7481 of 2003 before the Joint Collector, Ranga Reddy District. In the said review petition, two other brothers filed implead petition on 14.11.2006. This writ petition is instituted alleging that the said review petition is yet to be considered and finalized and kept pending without any justification. 2.

Thus, the only issue for consideration is whether the said review petition was filed and if so the same is kept pending so far without any justification.

On instructions, learned Assistant Government Pleader submits that review petition is pending consideration by the competent authority.

Having regard to this statement, writ petition is disposed of, without expressing any opinion on merits, directing the Joint Collector (2nd respondent) to consider and dispose of the review petition bearing No.E3/7481 of 2003 pending before him as expeditiously as possible, preferably within a period of four months from the date of receipt of a copy of this order, after affording due opportunity to the effected parties.

It is made clear that there is no opinion expressed on the merits of the case and that maintainability of the review petition is not decided and all the claims and defences as available in law in

favour of the respondents 3 and 4 are preserved to be agitated before the Joint Collector. It is further made clear that the only issue decided is, since the review petition is made in the year 2003 and alleged that it is kept pending, direction is issued to consider and pass orders on the said review petition.
