THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4185 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated above it is therefore prayed that this Hon'ble High Court may be pleased to issue a writ, order, or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not considering the petitioner's representation dated 31-8-2015 for withdrawing the LOC (Look Out Circular) published after registering the crime No.200/2010 dated 22-11-2010 on the file of the Amalapuram Town Police Station, against the petitioner U/s 498-A, 506 r/w 34 of IPC and section 3 & 4 of the Dowry Prohibition Act, even though the petitioner acquitted from the above said offence, as being illegal, arbitrary and contrary to law and consequently direct the 2nd respondent to withdraw the LOC by considering the petitioner's representation dated 31-8-2015 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
The Sub-Divisional Police Officer, Amalapuram, filed a counteraffidavit, wherein he stated that the Look Out Circular against the petitioner was withdrawn by the Assistant Director, IB, CBI, New Delhi.
In the light of the afore-stated unrebutted averment made by the police authorities, the cause in this writ petition does not survive for consideration on merits.
