HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.4062 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioner/A7 seeking to quash the proceedings in C.C No. 137 of 2017 on the file of VII Additional Metropolitan Magistrate, Bheeminipatnam, Visakhapatnam, registered for the offences under Sections 468, 471 & 420 r/w 34 IPC of PM Palem Police Station, Visakhapatnam City.

Having regard to the fact that the charge sheet is filed and the case is registered as CC No. 137 of 2017 and as it is informed that the matter is coming up for appearance of the accused, it is not apposite to quash the proceedings at this stage. However, liberty is given to the petitioner/A7 to file an appropriate application for discharging him, in which case, the trial Court shall pass appropriate order on merits. The appearance of the petitioner/A7 after initial appearance before the trail Court is dispensed with until further orders except on the occasions when the trial Court requires his attendance. Accordingly, the Criminal Petition is disposed of.
