HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL REVISION CASE No.178 OF 2014 JUDGMENT:
No representation for the revision petitioner. In fact, the revision petitioner got the delay of 23 days condoned in Crl.R.C.M.P. No.3164 of 2012 on 03.02.2014.
2. The present Criminal Revision Petition is filed questioning order, dated 02.07.2012, in Crl.M.P. No.1050 of 2012 in D.V.C. No.44 of 2012 passed by the learned Additional Judicial Magistrate of First Class, Karimnagar, whereby and where-under, he ordered the revision petitioner to pay an amount of Rs.2,000/- to respondent No.1 herein towards her maintenance from the date of the said order.
3. Since no representation for the revision petitioner and the matter has been coming up for admission for the past three years, and the order in Crl.M.P. was passed in the month of July, 2012, it is felt desirable to dispose of the present Criminal Revision Case on merits.
4. The order would reflect that the revision petitioner - husband was doing a private job, earning Rs.20,000/- per month, besides getting rentals at Rs.1,00,000/-. That has been the
submission made by respondent No.1 - husband before the D.V.C. Court.
5. The learned Magistrate observing that no document is filed by the wife in proof of income and opining that respondent No.1 herein is a house-hold lady, and keeping in view, the occupation of revision petitioner - husband and keeping in view the cost of living during those days when the order was passed, opined that it would be reasonable to grant Rs.2,000/- towards interim maintenance and, accordingly awarded it. The order does not suffer from any infirmity at all. The amount awarded was only Rs.2,000/- towards interim maintenance as against the claim of Rs.10,000/- sought for by respondent No.1 - wife. The present Criminal Revision Case is devoid of merit.
6. The present Criminal Revision Case is, accordingly, dismissed.
As a sequel thereto, Miscellaneous Petitions, if any, pending in the criminal revision case, stand closed.
