THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.14669 OF 2016 ORDER:

This criminal petition is filed under Section 482 of the Code of Criminal Procedure, 1973 to quash the proceedings in C.C. No.307 of 2016 on the file of XIX Metropolitan Magistrate at Kukatpally, on the various contentions.

The main contention urged before this court is that he executed a promissory note and issued a cheque as security and that no statutory notice was issued in terms of Section 138 of the Negotiable Instrument Act, 1881 prior to filing of CC No.307 of 2016. However, at the stage of hearing, learned counsel for the petitioner wanted to raise all these pleas before the trial court.

In view of the request made by the counsel for the petitioner, the petitioner is permitted him to raise all legal contentions in C.C. No.307 of 2016 pending before the XIX Additional Judicial Magistrate of First Class, Kukatpally. Accordingly, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
