THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3504 OF 2022 ORDER:
This criminal petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.3 and 4 in connection with Crime No.442 of 2021 on the file of Station House Officer, Kodad Town Police Station, Suryapet District, wherein the petitioners/Accused Nos.3 and 4 were alleged to have committed the offence punishable under Section 8(c) read with Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act').

Heard the learned counsel for the petitioners/Accused Nos.3 and 4 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the police seized 22 kgs of ganja from Accused Nos.1 and 2 and these petitioners/Accused Nos.3 and 4.

The petition filed by Accused No.1 was withdrawn on 22.04.2022 vide Crl.Petition No.3517 of 2022. Learned Assistant Public Prosecutor informed that there was a case pending against Accused No.1, as far as these petitioners are concerned, there are no prior criminal antecedents, for which reason, the petitioners/Accused Nos.3 and 4 can be granted bail. 5.
Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.3 and 4 are granted bail subject to the following conditions:
i) The petitioners/Accused Nos.3 and 4 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with one local surety and another one native surety for a like sum each to the satisfaction of the Judicial First Class Magistrate at Kodad.
ii) The petitioners/Accused Nos.3 and 4 shall appear before the Station House Officer, Kodad Town Police Station, Suryapet District, on every Sunday between 10.00 a.m. and 1.00 p.m. for a period of three (03) months.
iii) In the event of these petitioners/Accused Nos.3 and 4 indulging in any similar activity attracting penal consequences under NDPS, the bail is liable to be cancelled.
iv) The petitioners/Accused Nos.3 and 4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 25.04.2022 ns
