HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.21154 of 2003 ORDER :

When the matter is taken up for hearing, it is noticed that the petitioner retired from service on attaining the age of superannuation.

The grievance of the petitioner is that the respondents have not paid subsistence allowance when he was placed under suspension.

In view of the above, this Court is of the considered view that this writ petition can be disposed of directing the petitioner to submit representation afresh to the respondents seeking payment of subsistence allowance, gratuity and encashment of leave within two weeks from the date of receipt of a copy of this order.

Upon such representation being received, the respondents shall consider the same and pass appropriate orders, in accordance with Rules, within a period of eight weeks thereafter, if not already paid subsistence allowance to the petitioner.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
