THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.400 OF 2014 ORDER:

This petition is filed by the petitioners-respondents Nos.2 & 3 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.325 of 2013 on the file of the III Additional Judicial First Class Magistrate, Chittoor, Chittoor District. Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 498-A IPC and Sections 3 & 4 of the Dowry Prohibition Act.

Considering the facts and circumstances of the case and the nature of the proceedings, this Court is not inclined to interfere with the proceedings in the above C.C. At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the Court below. In view of the request made by the learned Counsel for the petitioners, the presence of the petitioners-accused Nos.2 & 3 before the Court below is dispensed with, except on the dates when their presence is insisted by the Court below. It is made clear that the petitioners shall be represented before the Court below through their Counsel on all hearing dates. With the above direction, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
