THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.32896 of 2015 ORDER:
Petitioner is one of the applicants to the petroleum outlet proposed to be established by the respondent Corporation. However, Ex.P.1 - reply given to the petitioner under the Right to Information Act, 2005 shows that the respondent Corporation decided to put the process on hold and hence, no further steps were taken by it. The petitioner, who was one of the applicants, now seeks a mandamus that the respondent Corporation should follow the due procedure to conduct lottery for allotment and consider his application.
I am of the view that it is entirely for the respondent Corporation and its policy whether to establish petroleum outlet or not and the petitioner who is merely an applicant cannot compel the respondent Corporation to go through the process. The Writ Petition is thoroughly misconceived and the petitioner has absolutely no legal right.
The Writ Petition is accordingly dismissed.
Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
