HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.3448 of 2015 in Crl.P.No.8745 of 2013 and Criminal Petition No.8745 of 2013 COMMON ORDER:

T h e defacto complainant and her counsel Sri T. Sreedhar are present. A.1 and his Counsel Sri B.Vijaysen Reddy are present. A.2 to A.5 are absent.

Heard both sides and perused the petitions.

On the report given by the defacto complainant, the police of Kushaiguda P.S, Cyberabad registered Crime No.470 of 2012 and investigated and laid charge-sheet against A.1 to A.5 for the offences under Sec.498A IPC and Sections 3 and 4 of Dowry Prohibition Act and learned X Metropolitan Magistrate, at Malkajgiri, Cyberabad took cognizance and registered as C.C.No.711 of 2013. While so, today the defacto complainant and A.1 along with Counsel present and submitted that at the intervention of elders they have amicably resolved all their disputes and they are living together and as such, the defacto complainant has no objection for quashment of the proceedings against all the accused in C.C.No.711 of 2013 on the file of X Metropolitan Magistrate, at Malkajgiri, Cyberabad Hyderabad and hence, the Court may be pleased to accord permission to compound the offence and accordingly, quash the proceedings in the interest of justice.

Having regard to the above submission and in view of the fact that it is a matrimonial matter wherein the parties have amicably resolved their disputes, no useful purpose will be served if they are driven to trial since they compromised the issue and following the decision reported in Gian Singh vs. State of Punjab and another this petition is allowed and permission is accorded to the parties to compound the offence and proceedings against all the accused in

C.C.No.711 of 2013 on the file of X Metropolitan Magistrate, at Malkajgiri, Cyberabad are hereby quashed.

In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
