THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.16104 of 2008 ORDER:

The writ petition is filed seeking the following relief/s: '..to issue any appropriate writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the Respondents in not granting extension of leasehold rights in favour of the petitioner society in respect of the tank of K.Jagannadhapuram panchayat for the period from 2008-2010 as illegal, aribtrary and violative of fundamental rights guaranteed under the constitution and consequently direct the Respondents to grant leasehold rights in favour of the petitioner society to the petitioner society in respect of the tank of K. Jagannadhapuram panchayat, East Godavari District for the period from 2008-2010 and pass such other order....' There is no representation for the petitioner.

The learned Government Pleader for Panchayat Raj & Rural Development would submit that the subject matter relates to extension of leasehold rights for the period from 2008-2010 and that in view of the years elapsed subsequent to the filing of the writ petition, no cause survives for adjudication and that, therefore, the writ petition is liable for dismissal on that ground. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
