ORAL ORDER:

This writ petition is filed alleging that the Tahsildar is interfering and dispossessing the petitioner from the land to an extent of Ac.0.81 1⁄2 cents in Survey No. 315/1 (New 315/1A) Kanithi village, Visakapatnam. 2.

Heard learned counsel for petitioner, learned Assistant Government Pleader for Revenue and learned counsel for 5th respondent and with their consent the writ petition is taken up for disposal at the admission stage.

From the averments made in the affidavit, it appears that there is inter-se dispute between petitioner and 5th respondent, however, it is not stated why revenue authorities would interfere if it is a private patta land belonging to petitioner. On instructions, learned Assistant Government Pleader, fairly submits that the revenue authorities are not interfering in the matter.

According to learned counsel appearing for unofficial respondent O.S. No. 53 of 2011 filed by S Mahalaxmi is pending on the file of Junior Civil Judge, Gajuwaka and there is inter-se dispute. 5.

Since, learned Assistant Government Pleader, on instructions asserts that revenue authorities are not interfering in the matter, writ petition is misconceived and accordingly the same is dismissed. No costs.

Having regard to the same, miscellaneous petitions, if any pending, are closed.
