THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.23974 of 2017 ORDER:

The allegation of the petitioner in the writ affidavit is that he is entitled to receive the compensation along with respondent Nos.7 to 9 for the land acquired for the purpose of Polavaram Project. Apprehending that compensation amount would be paid to respondent Nos.7 to 9 without considering his claim, the petitioner filed this writ petition.

On 21.08.2017, while issuing notice before admission, this Court granted stay of disbursement of the amount, pursuant to the Award, if any.

Today, when the matter is taken up for consideration, learned Government Pleader for Land Acquisition and the learned counsel for respondent Nos. 7 to 9 submit that the Award came to be passed on 29.06.2017 and the amount was also credited to the accounts of respondent Nos.7 to 9 in the last week of July, 2017.

In view of the above, learned counsel for the petitioner submits that the writ petition may be closed, giving liberty to the petitioner to take appropriate steps by invoking Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Settlement Act, 2013.

Hence, the writ petition is closed, giving liberty to the petitioner to take appropriate steps by invoking Section 64 of the above said Act.

Miscellaneous Petitions, if any pending shall stand closed. There shall be no order as to costs.
