ORDER:

Petitioner questions the notice dated 15.05.2015 issued by the Recovery Officer, Employees' Provident Fund Organization of the second respondent.

2. The impugned notice demanded from the petitioner arrears quantified at Rs.1,53,129/- and the petitioner states that he has paid Rs.50,000/- on 10.06.2015. Petitioner states that the delay in payment is attributable to the Electricity Department and that if sometime is granted, petitioner will be able to pay all the dues.

3. Heard Mr. R.N. Reddy, learned standing counsel for the second respondent, who also accepts that the petitioner has paid Rs.50,000/- after the impugned notice.

Since about Rs.1,00,000/- is further payable, I deem it appropriate to dispose of the writ petition by granting petitioner time to pay the balance amount in two equal monthly installments, in equal halves, each payable in the month of September 2015 and October 2015 respectively. The first installment shall be paid by the petitioner on 15.09.2015 and the remaining amount by 15.10.2015. Subject to the payment aforesaid, the impugned notice shall not be enforced against the petitioner. However, in default, it is open for the second respondent to take appropriate steps in accordance with law.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
