HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.328 of 2014 ORDER:

This petition is filed to withdraw O.P.No.900 of 2012 from the file of Family Court, Visakhapatnam and transfer the same to Family Court, Secunderabad.

2. Petitioner herein is wife and she filed her affidavit in support of the petition, according to which, her marriage with respondent was performed on 02.09.2010 at Simhachalam, Visakhapatnam District and after marriage she joined her husband at Anakapalli and lived together till 27.05.2011 and she went to her parent's house for delivery. She further stated that she gave birth to a female child on 01.10.2011 and form that date respondent did not visit her and did not take any steps to take her back and she was forced to stay back at her parents house. She contended that she is now employed at Hyderabad and it is difficult for her to travel all the way from Hyderabad to Visakhapatnam for defending O.P.No.900 of 2012 with a small baby. She contended that from December,2013 she is employed at Hyderabad and it is highly inconvenient for her to perform journey covering a distance of 700 KMs from Hyderabad to Visakhapatnam and prayed for transfer of O.P.No.900 of 2012 from Visakhapatnam to Secunderabad.

3. Respondent/husband has not filed any counter in spite of taking time.

4. Heard arguments.

5. I have perused the material papers i.e., affidavit filed by

petitioner/wife in support of the transfer petition. Affidavit averments of petitioner/wife remained un-challenged as the husband/respondent has not filed any counter.

6. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P No.900 of 2012 is withdrawn from Family Court, Visakhapatnam and transferred to Family Court, Secunderabad for disposal in accordance with law.

7. Accordingly, this Transfer Miscellaneous Petition is allowed. No costs. Miscellaneous Petitions, if any pending, in this petition, shall stand closed.
