HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19815 OF 2016 ORDER:

The writ petition is filed questioning the inaction of the respondents 2 to 4 in acting upon the representation dated 12.02.2016 submitted by the petitioner and taking necessary action in protecting the rights of the petitioner in respect of the land over an extent of Ac.4.80 cents situated in Sy.Nos.204/3 and 204/4 of Rachervurajupalem Village, Lingasamudram Mandal, Prakasm District.

The main grievance of the petitioner is that he has submitted a representation dated 12.02.2016 to the respondent-authorities seeking protection from the third parties from interfering with his possession and enjoyment of the above said lands. As there is no response from the respondent-authorities, the petitioner filed the present writ petition. Having heard the learned counsel for the petitioner and having perused the record, though there is a representation dated 12.02.2016 said to have been submitted by the petitioner and placed the same on record, a perusal of the representation does not disclose from whom and in what manner, the petitioner is being troubled. In the absence of any specifics of the nature of interference and the persons who are interfering, the respondent-authorities by themselves cannot help the petitioner.

Further, as can be seen from the representation, which is placed on record, there is no allegation that any of the official respondents being interfered with or tried to interfere with the possession and enjoyment of the petitioner. On the other hand, in the representation, there are bare allegations that certain persons are preventing the petitioner from cultivating his lands. If it is any private individuals are the ones who are trying to interfere with the possession based on the title which has been granted to the petitioner by way of a patta and with the possessory rights which the petitioner possesses on account of the petitioner having been granted pattadar pass books, petitioner may be advised to approach the appropriate civil court seeking the injunctive relief.

In those circumstances, the writ petition is disposed of with a direction to the petitioner to approach the competent civil court seeking the relief against the specific persons who are interfering or trying to interfere

with the possession and enjoyment of the petitioner. With the above observations, the writ petition is disposed of. No order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
