Heard learned counsel for the petitioner and learned Government Pleader for Social Welfare appearing for respondent No.1.
Petitioner states that respondent No.4-Settlement Officer-cumRevenue Divisional Officer, Bhadrachalam rejected his case vide proceedings, dated 19.12.2016, for grant of ryotwari patta in respect of the land admeasuring Acs.2.00 in Survey No.14/2 of Marrigudem Village, Venkatapuram Mandal, Jaya Shankar Bhupalpally District, under Regulation 2 of 1970. Aggrieved by the said order, he filed an appeal before respondent No.2-Director of Survey & Settlements of Telangana, Hyderabad, who in turn, did not entertain the same on the ground that G.O.Rt.No.1001, Revenue (Services.I/1) Department, dated 02.05.2008, was issued by the Government delegating the powers of respondent No.2 under Regulations 1 of 1969, 2 of 1969, 2 of 1970 and 1 of 1989 to the Project Officers of ITDAs, who are Additional Agents to the Government. However, challenging the said Governmental Order, W.P.No.14197 of 2009 was filed and this Court by order, dated 16.07.2009, granted interim suspension of the said Governmental Order.
In view of the said interim order, when similar cases were not considered by respondent No.2, this Court by order, dated 13.03.2014, in W.P.Nos.6430 and 6475 of 2014, directed
respondent No.2 to dispose of the appeals pending before him irrespective of the aforesaid Governmental Order. In view of the above, this writ petition is allowed directing respondent No.2 to take up the appeal preferred by the petitioner on 23.02.2017 against the order, dated 19.12.2016, passed by respondent No.3, and dispose of the same in accordance with law.
