THE HON'BLE SRI JUSTICE B.VIJAYSEN REDDY Criminal Petition No.5638 of 2024 ORDER:

This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (Cr.P.C.) is filed by the petitioner-accused No.5 in Crime No.26 of 2020 of Ghatkesar Police Station, registered for the offences punishable under Section 8(c) read with Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act'), for grant of regular bail.

Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent- State. Perused the record.

Petitioner is accused No.5 in the aforesaid Crime. He was arrested in connection with the aforesaid crime and was remanded to judicial custody on 21.09.2022 in execution of PT warrant and has been in jail since then.

Learned counsel for the petitioner submits that accused Nos.1, 2 and 4 in the aforesasid crime have already been granted bail by this Court vide separate orders dated 28.08.2020, 16.06.2020,

and 21.04.2020 in Crl.P.Nos.3202 of 2020, 2420 of 2020 and 2007 of 2020 respectively.

In view of the same, this Court is inclined to grant bail to the petitioner, who is accused No.5 in the aforesaid crime, subject to certain conditions.

Accordingly, this Criminal Petition is allowed and the petitioner-accused No.5 is directed to be released on bail subject to the following conditions:

i. The petitioner-accused No.5 shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned Metropolitan Sessions Judge, MedchalMalkajgiri District at Kushaiguda. ii.
