O R D E R

The case of the petitioners is that they are the owners and pattadars of the subject land and their grievance is that the respondents are laying road in the subject property without following due process of law. The Panchayat Secretary of the 5th respondent - Gram Panchayat filed counter affidavit stating that there is civil dispute between the petitioners and the third parties, and that they never entered into the subject property or laid road as alleged by the petitioners.

Recording the statement made in the counter affidavit, writ petition is disposed of directing the respondent No.5 not to lay road in the subject property of the petitioners without following due process of law. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
