THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1291 of 2016

ORDER

This criminal petition under sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner-A1 seeking to grant bail in connection with Cr.No.118 of 2015 of Gollaprole Police Station, East Godavari District, registered for the offence punishable under Section 8(c) r/w 20(b)(i) of NDPS Act, 1985.

2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

It is alleged that on 10.08.2015 at 4.30 PM., near Bondapati Naganna mango tree garden, the Excise Officials found A1 and A2 in possession of 125 Kgs of ganaj worth Rs.12,50,000/- transporting illegally in an auto.

4. The petitioner is in judicial custody since 10.08.2015. Since the contraband seized from the possession of the accused is a commercial quantity, this Court is not inclined to grant bail to him. 5.
