THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15537 OF 2009 ORDER:

This Writ Petition is filed seeking to declare the action of the respondents in laying the outer ring road in Survey No.20-12/A of Shankarapur Village, Shamshabad Mandal, Ranga Reddy District, without acquiring the same and not paying the compensation, which affects the petitioner's rights guaranteed under Articles 21, 31-A (1) and 300-A of the Constitution of India over an extent of Ac.0.20 guntas, as arbitrary and illegal.

No counter-affidavit is filed denying the averments made in the affidavit filed in support of the writ petition either with respect to the ownership of the petitioner or any proceedings having been initiated. However, this Court, while admitting the Writ Petition on 31.07.2009, ordered W.P.M.P.No.20401 of 2009 to the effect that the respondents shall not make the construction of outer ring road and they shall not dispossess the petitioner from the land in question, without following due process of law. Since the main prayer in the writ petition is also being the same and considering the fact that the relief already stands granted, the order passed on 31.07.2009 is made as a final order in the present writ petition. 3.

Accordingly, the Writ Petition is disposed of specifically holding that the respondents shall not interfere with the peaceful possession and enjoyment of petitioner over the subject land, without following due process of law.
