THE HON'BLE SRI JUSTICE B.VIJAYSEN REDDY Criminal Petition No. 5639 of 2024 ORDER:
This Criminal Petition, under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (Cr.P.C.) is filed by the petitioner/accused No.1 in C.O.R.No.13 of 2024 of Prohibition & Excise Station, Shamshabad, registered for the offences punishable under Section 8(c) r/w Section 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act'), for grant of regular bail.
Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent- State. Perused the record.
Learned counsel for the petitioner submits that accused Nos.2, 3 and 4 in the aforesasid crime have already been granted bail by this Court vide common order dated 30.04.2024 in Crl.P.Nos.4807 and 4839 of 2024 and order dated 18.03.2024 in Crl.P.No.2994 of 2024.

In view of the same, this Court is inclined to grant bail to the petitioner, who is accused No.1 in the aforesaid crime, subject to certain conditions.
Accordingly, this Criminal Petition is allowed and the petitioner-accused No.1 is directed to be released on bail subject to the following conditions:
i. The petitioner-accused No.1 shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned XIII Additional Metropolitan Sessions Judge, Ranga Reddy District at L.B.Nagar.
ii. The petitioner-accused No.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. iii. The petitioner-accused No.1 shall not involve in any cases during the pendency of trial and if any adverse report is received against him, the bail granted to him is liable to be cancelled.
iv. The petitioner-accused No.1 shall appear on all the days when the matter is posted for trial without seeking any exemption.
