THE HON'BLE SRI JUSTICE P.NAVEEN RAO CIVIL REVISION PETITION No.227 of 2016 ORDER :

During pendency of the suit in O.S.No.01 of 2016 on the file of Junior Civil Judge, Uravakonda, the trial Court granted injunction order in I.A.No.02 of 2016. Praying to vacate the said injunction order, petitioners herein filed I.A.No.07 of 2016 in O.S.No.01 of 2016. When I.A.No.07 of 2016 was taken up on 07.01.2016 the trial Court while ordering notice to the respondent adjourned the matter to 04.02.2016. At this stage, this Civil Revision Petition is filed.

2. Since the subject matter is now pending consideration before the trial Court and that too, when the trial Court ordered only notice, at this stage this Court is not inclined to exercise the revisional jurisdiction and pass orders which would nullify the proceedings before the trial Court. The petitioners are not remediless and they can work out their remedies as available in law as and when orders are passed in I.A.No.07 of 2016 or if the matter is dragged on without disposing of the I.A.

3. Having regard to the facts of the case, granting liberty to the petitioners to seek early disposal of I.A.No.07 of 2016 in O.S.No.01 of 2016 pending before the trial Court, this Civil Revision Petition is dismissed. There shall be no order as to costs.

4. Miscellaneous petitions, if any, pending in this civil revision petition shall stand dismissed.
