HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13709 OF 2019 ORDER:

This writ petition is filed challenging the action of respondents in unilaterally converting service connection of petitioner from LT Category-III (Industrial) to LT Category-II (Commercial) without passing final order of assessment pursuant to petitioner's objections dated 12-06-2019 to the provisional assessment order dated 07-05-2019 in terms of Section 126 of the Electricity Act, 2003 (for short "the Act"). Learned counsel for the petitioner as well as learned Standing Counsel for the respondent-Company submits that the writ petition may be disposed of directing the competent authority to pass final orders under Section 126(3) of the Act.

In view of the same, the writ petition is disposed of with a direction to the competent authority to pass final orders under Section 126(3) of the Act, after affording an opportunity of hearing to the petitioner, in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. Till then, interim order granted on 05-07-2019 shall continue. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
