HONOURABLE SRI JUSTICE S.RAVI KUMAR TRANSFER CRIMINAL MISCELLANEOUS PETITION No.318 OF ORDER:

This petition is filed to withdraw O.P.No.108 of 2014 from Family Court, Ranga Reddy and transfer the same to Ranga Reddy, Kurnool.

Wife is the petitioner. According to her affidavit, her marriage took place at Kurnool on 07.05.2009 with the respondent and after leading happy marital life for some time due to vices of the respondent-husband, she was forced to live separately.

She stated that she filed M.C.No.49 of 2012 before Family Court, Kurnool and D.V.C. before Additional Judicial Magistrate of First Class (Excise Court) Kurnool and both the cases are pending and respondent-husband is attending for those two cases. It is stated that she cannot travel from Kurnool to Hyderabad for defending the O.P. filed against her, as she apprehend danger in the hands of respondent at Hyderabad. For these reasons, she prayed transfer of O.P.108 of 2014 from Ranga Reddy to Kurnool.

Respondent inspite of service of notice neither appeared in person nor through advocate.

Heard arguments.

Considering the reasons stated in the affidavit and also considering the convenience of wife and the fact that two cases filed by wife are pending at Kurnool, O.P.No.108 of 2014 is withdrawn from Family Court, Ranga Reddy and transferred to Family Court, Kurnool for disposal in accordance with law.

Transfer Criminal Petition is ordered accordingly. Miscellaneous petitions pending if any in this criminal petition, shall stand closed.
