HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 21506 OF 2011 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue. With the consent of both parties, the present writ petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to declare the action of the respondents in forcebily taking over petitioners' plots bearing Nos.1 to 4 in Survey No.175 of Rekurthi Village, Karimnagar Mandal and District, as illegal and arbitrary.

Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the District Collector to pass appropriate orders on the representation dated 15.02.2009, made by the petitioners to provide alternate land or pay compensation at the prevailing price as per law. Learned Government Pleader for Revenue does not dispute the same. However, he submits that if the said representation is still pending, the respondents may be directed to dispose of the same, in accordance with law. Without going into merits of the case and having regard to the request made by the petitioners, the District Collector/respondent No.1 shall dispose of the representation dated 15.02.2009, made by the petitioners, as early as possible, preferably within a period of twelve (12) weeks from the date of receipt of a copy of this order, in accordance with law, if the same is still pending. It is needless to mention that it will be appropriate if an opportunity of hearing be given to the petitioners at the time of disposal of the representation.

Accordingly, the writ petition is disposed of. No costs.

Consequently, the Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
