THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.22094 of 2017 ORDER:

Heard Sri K.S.Murthy, for petitioner and the Assistant Government Pleader (Revenue) for respondent Nos.2 to 4. The petitioner challenges the impugned order No.RCB 114/2017, dated 26.04.2017, as illegal and unsustainable. The petitioner alleges that he has already availed the remedy of appeal against the order impugned in the writ petition. One of the reasons for invoking the jurisdiction of this Court is that the Appellate Authority is not passing the orders on the stay application moved by petitioner and at the same time, respondent Nos.3 and 4 are taking steps to dismantle the bore well and to disconnect the power supply. I have perused the material available on record. This Court is satisfied that during the pendency of the application filed by the petitioner for interim relief, if the physical features of bore well etc., are changed, the petitioner suffers loss and hardship.

Hence, the Writ Petition is disposed of by this order. 1) The Appellate Authority is directed to dispose of the application filed by the petitioner for the interim relief within four weeks from the date of receipt of a copy of this order.

2) The parties are directed to maintain status quo in all aspects for a period of six weeks from today.

3) The petitioner is given liberty to file a memo by enclosing a copy of this order for a date in the stay application moved in this behalf.

No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
