HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.398 of 2017 ORDER:

The prayer in the writ petition is as under:

" to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 1 to 3, particularly respondent No.3 for not registering the crime, by issuing First Information Report upon the report/ complaint in Lr. Rc.No.A/ 392/ 2015 dated 26-092016 and Rc.No.B/ 392/ 2015 dated 21-11-2016 of the Tahsildar, Kothaguda Mandal, Mahaboobabad District against respondent No.5 in respect of the offence punishable under regulation 6-A of the A.P. Scheduled Areas Land Transfer Regulation, 1959 and against the spirit of Articles 14, 21, 300A & 244(1) of the Constitution of India as illegal, arbitrary, unconstitutional and consequently direct the respondents 1 & 2 to register the F.I.R. against respondent No.4 for the offence under Section 217 IPC and pass..."

The respondents 2 and 3 are present. Heard the learned counsel for petitioner, and the learned Government Pleader for Home (TG) for the respondents 1 to 3 and perused the prayer in the writ petition with supporting affidavit and other material on record.

In fact, it is the submission of the learned Government Pleader for Home (TG) that the F.I.R. in Crime No.39 of 2018 is registered and taken up investigation.

Having regard to the above, this Writ Petition is disposed of.

Respondent No.3 shall intimate the progress of investigation, by early completion of investigation, to the petitioner. No order as to costs.

Dr. SSRB, J W.P. No.398 of 2017 Miscellaneous Petitions pending, if any, shall stand closed.
